Stalking is a relatively new crime, which means that it is evolving quickly with the advent of new electronic mediums used to harass victims. Anti-stalking legislation exists in every state, but is not uniform. Therefore, victims are not receiving adequate justice. All the while, perpetrators and victims are perceived differently in courts of law depending on their varying identity politics based on gender, race, and class. Discursive social constructions formed by circulating media representations work to trivialize the crime and turn it into a colloquial joke. States deemed progressive, moderate, and negligent are analyzed to offer possible remedies for equitable legal enforcement
